1.1 Home Lighting Ideas by K&S is a trading name for Kate and Sam Lighting Designers Ltd, a company registered in England and Wales under company number 9753406 whose registered address is at Saint Lawrence Lodge, 37 Chamberlain St, Wells BA5 2PQ, hereinafter referred to as ‘Home Lighting Ideas’ or ‘we’, operate the Website at www.HomeLightingIdeas.com (the ‘Site’).
1.2 In these Terms, references to ‘You’ or ‘Your’ or ‘User’ shall mean the person visiting or using the Site. We set out the following terms and conditions to govern your use of the Site. By accessing any page of our website and/or ordering services from us, you agree to be bound by these terms. If you do not agree to be bound by these terms and conditions you may not use or access this Website.
2. How We Work
2.1 Home Lighting Ideas provides a remote online digital Lighting Design service via video conference and email communication.
2.2 The description of Home Lighting Ideas services is as set out in ‘How It Works’ section of pages on the home lighting ideas website.
2.3 All services which appear on the home lighting ideas site are subject to availability.
2.4 We will keep you informed about any changes to the home lighting ideas services that you have booked and we will respond to any queries promptly and efficiently.
2.5 The Service is provided by booking an appointment on the Home Lighting Ideas diary via the website. When choosing to pay you must provide your name, email address, and postcode.
2.6 On completion of placing the Order you will be sent a confirmation email which includes a download link to a project questionnaire, simple questions about your project. This will in effect act as Your brief to Us setting out what you hope to reasonably achieve. The same email will also include a Home Lighting Ideas upload link to allow you, should you wish, to upload any information you consider to be useful to us about your project. We will review the information sent and select the best lighting designer for the project.
2.7 Providing you provide us with all the information we need in an electronic format we can use, we will deliver our Services to you within a reasonable timely manner aiming to fit in with your project programme.
3. Our Services
3.1 We will exercise reasonable skill and care in carrying out the services you have ordered from us.
3.2 Whilst we will use all reasonable endeavours to ensure that any drawings produced by us as part of our services are accurate, you must ensure that, if your project goes to construction, all drawings and measurements are checked on site by your appointed contractors before work commences. We will not be liable for any inaccuracies that come to light after work commences.
3.3 Any planning and design drawings produced by us as part of our services should be relied on for planning and design development purposes only. If your project goes to construction, they are not a substitute for detailed technical drawings, which will be required to ensure a safe coordinated installation that complies with Building Regulations.
3.4 Any specifications we produce should be relied on for planning and design development purposes only. If your project goes to installation it will remain the responsibility of the on site electrical designer/electrician/installer to ensure that manufacturer installation guidelines are followed and that the installation is compliant with Health and Safety regulations and current Building Regulations.
3.4 If, as part of the services, you ask us to produce any illustrative drawings to help inform your decision these will be for illustrative purposes only and should not be used to replace the production of detailed technical drawings.
3.5 Some measurements shown by us may be based on assumptions and we cannot accept any responsibility for any such inaccuracies. All setting out and site dimensions should be checked and confirmed by the installer prior to installation.
3.6 Our services are intended to be provided remotely without us carrying out a site visit of your property. You are responsible for ensuring that any measurements you provide us with are correct and accurate. We cannot accept any responsibility for any incorrect measurements provided to us (whether by you or by any third party instructed by you or acting on your behalf). If your project goes to construction, it is important that your appointed contractors attend the site to complete a full measured or cross-checking survey and discuss your specific requirements.
3.7 If we provide our services alongside other professionals you have instructed, then it is your responsibility to ensure that all information held by those other professionals that could be relevant to our services is communicated to us promptly. We will not be liable for any inaccuracies in information provided to us by those other professionals.
3.8. We shall not be under any obligation to update any information, report or content provided to you as part of our services to take account of events occurring after such information, report or content has been provided to you.
3.9 We do not offer any guarantee that information provided by us complies with Building Control regulations and Health and Safety regulations. Design information produced by us is intended to be used as starting point of the Lighting Design and development process. Information provided by us is to be interpreted and developed into a compliant design either by You/ Your design team and/or a suitably qualified installing contractor.
3.10 We cannot guarantee that our drawing package is fully compliant as on site conditions may result in the need to make changes to the design to ensure compliance.
3.11 Any project cost or other estimates provided by us, whether through our website or otherwise, are based on available data and averages, as well as information supplied by you, and are not definitive. They are provided for guidance purposes only and we cannot and will not accept any responsibility if they turn out to be inaccurate.
3.12 If you choose to provide us with any drawings or plans prepared by third parties (for example, other architects), we will seek to identify (but cannot and will not accept any responsibility for) any inaccuracies or inconsistencies in them and agree with you the next steps to be taken.
4.1 Home Lighting Ideas does not offer an Installation Service. All electrical work in dwellings in England and Wales whether carried out professionally or as DIY, and whether or not the work is notifiable to a building control body, must meet the requirements of Part P of the Building Regulations. We strongly recommend that you use a registered electrician to do any electrical work. If you use a registered electrician, you can expect to have safe electrical installation work done, as the work should meet the UK national standard, BS 7671 (Requirements for Electrical Installations).
5. Changes to Our Services
5.1 We reserve the right to update or withdraw any Services from this website at any time.
6. Changes to Our Site
6.1 We may update our Site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our Site, or any content on it, will be free from errors or omissions.
7. Changes to Our Terms
7.1 We reserve the right to make reasonable modifications to these terms at any time without notice by posting the changes on this page. You agree that Home Lighting Ideas will treat your continued use of the Site as acceptance of these terms as may be amended from time to time.
8. Prohibited Use of the Site

By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities.
8.7 You agree that your use of the Service will not include sending unsolicited marketing messages or broadcasts (i.e. spam), Home Lighting Ideas will utilise any means possible to block spammers and abusers from using the Service. 8.8 Users are reminded that the following conduct is not allowed on the Home Lighting Ideas service:
- Obscene, profane threatening or verbally abusive language

- Uploading of inappropriate material.

8.11 We also have the right to disclose your identity to any third party who is claiming that any content uploaded by you to our site constitutes a violation of their intellectual property rights or of their right to privacy.
9. Intellectual Property and Copyright
9.1 Unless we agree otherwise, Home Lighting Ideas owns the Intellectual Property Rights and Copyright in the work produced by performing the services and generally asserts the right to be identified as the author of the artistic work of lighting design within the project.
9.2 You have the right to use such documents and materials for the purposes for which they are created, but not otherwise.
9.3 Our work is undertaken for your benefit alone and we are not responsible to third parties for any aspect of our Home Lighting Ideas services or work that you make available to them.
10. Rights to Content
10.1 As a User you will be able to upload content, such as mood images, pictures of your space, floor plans and household objects. Home Lighting Ideas claims no ownership or control over Your Content. You or a third-party licensor, as appropriate, retain all copyright, patent, and trademark rights to any of Your Content that you share on or through the Service. You are responsible for protecting those rights.

11.1 In order to provide the Service to our Users, we may provide links to third party websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter a linked website and we are not responsible for the any aspect of these sites and as such cannot be held responsible for them.
11.2 You assume all risk and we disclaim all liability arising from your use of them. We make no promises and disclaim all liability of specific results from the use of the Service.
12. Account Security
12.1 We will send you an email which includes access to an Upload service to share information about your project. You agree to use reasonable efforts to prevent unauthorised access to or use of the Service and to preserve the confidentiality of any device that you use to access the Service.
12.2 Electronic project information uploaded by you to the Home Lighting Ideas server will only be held for 30 days after the appointment. After 30 days the project information will be permanently deleted from our server and backup systems.
13. Terms of Sale
13.1 You must be at least eighteen (18) years of age to use Home Lighting Ideas services.
13.2 Description of the Services is described in the ‘How It Works’ section of the site.
13.3 Pricing of the various Packages is set out in the Pricing (https://homelightingideas.com/pricing/) section of the site.
13.4 Due to the way we work, we can only offer the ‘Shopping List’ and/or ‘Outline Lighting Plan’ Services after we have provided a ‘Lighting Design Workshop’ for your project.
13.5 Each step of the booking process allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.
13.6 When an order has been submitted on the Home Lighting Ideas site You will receive an automated confirmation email. However, we reserve the right to refuse service to anyone at any time at our sole discretion. We will try to tell you the reason.
13.7 Acceptance of Your order for Products or Home Lighting Ideas Lighting Design Services will take place when we email you to accept it, at which point a contract will come into existence.
13.8 No variation of the agreement can be made after it has been entered into unless the variation is agreed by both the Home Lighting Ideas customer (You) and (Us) Home Lighting Ideas in writing.
13.9 We reserve the right to withdraw any Services from this website at any time and/or remove or edit any materials or content on this website.
13.10 We will not be liable to you or any third party by reason of our withdrawing any Service from this Website whether or not that Service has been sold, removing or editing any materials or content on the Website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
13.11 If you need a Lighting Design service that is currently not listed on the Home Lighting Ideas website, please contact us via email and we’d happy to see if we can help.
14. Fees and Payment
14.1 We accept payment by PayPal and Stripe Payments. You must pay the full price for the Services upon placing Your order. We will charge You using the details You enter upon checkout.
14.2 All payments will be made to Kate and Sam Lighting Designers Ltd.
14.3 All prices published on the website are inclusive of VAT. Our VAT number is 227 3588 89
14.4 You confirm that the credit/debit/store card or PayPal account that is being used is yours or you are an authorised user.
14.5 If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery of the Service.
15.1 Should you need to reschedule your appointment contact us by email with your next available dates and we will try fit you in at the next first available free appointment.
16. How to End Your Contract
16.1 As this is a distance agreement, you have the right to cancel this agreement within 14 days of the start of the agreement.
16.2 UNLESS we have already started providing the Service, you can cancel this agreement within 14 days without giving any reason. Please inform us of your decision to cancel this agreement in writing setting out your decision. To meet the cancellation deadline we must receive your intent to cancel before the 14 days deadline.
16.3 If at your request the Service is to be provided within the statutory 14 days cancellation period of the agreement you accept that you will lose your right to cancel this agreement if the Service has been started or performed in full within the cancellation period.
16.4 In the event that we do cancel the Home Lighting Ideas Services before the end of the cancellation period in response to your express request to do so but we have BEGUN but not fulfilled the whole Agreement, you must pay a proportional amount for what has been supplied to the time when we are informed of your decision to cancel the Agreement. This amount is to be calculated on the basis of the total Agreed Price. You will be refunded the for the unfinished elements.Your refund will be made within 14 days of cancelling the agreement.
16.5 If you cancel the Home Lighting Ideas Services post the cancellation period, we shall not be liable to you to make any refund of the pre-paid agreed Fees in whole or in part notwithstanding that the Home Lighting Ideas Services do not progress to completion as originally intended. However, we will consider each request to Cancel on a case by case basis and advise you of our decision within 14 days of your request by email.
